Liability Waiver

I, hereby acknowledge that I am voluntarily participating in activities at Malibu Potteries located at Surf Canyon, 3728 Cross Creek Road, Malibu, CA 09265 (the "Facility"), which is owned and operated by Malibu Pottries LLC (the "Operator").

In consideration for being allowed to participate in these activities, I agree to the following:

Assumption of Risk: I understand and acknowledge that the activities at the Facility, including but not limited to interacting with animals, working with ceramics materials, and other related activities, involve inherent risks. These risks may include, but are not limited to, bodily injury, illness, or property damage.
Release of Liability: I hereby release, waive, and discharge the Operator and the Facility, its owners, employees, agents, and representatives from any and all liability for any harm, injury, damage, or loss suffered by me, including but not limited to bodily injury, illness, or property damage, arising from or related to my participation in activities at the Facility, regardless of whether such liability arises from the negligence of the Operator or otherwise.
Indemnification: I agree to indemnify and hold harmless the Operator and the Facility, its owners, employees, agents, and representatives from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising from or related to my participation in activities at the Facility.
Medical Treatment: I authorize the Operator and its representatives to administer or arrange for any medical treatment that they deem necessary or appropriate in the event of any injury, illness, or other emergency that may arise during my participation in activities at the Facility.
Photo Release: I grant the Operator permission to use photographs, video recordings, or other images of me taken at the Facility for promotional or other purposes without compensation to me.
I understand and acknowledge that the activities at the petting zoo involve interacting with animals, which inherently carries risks. I acknowledge that animals can be unpredictable and may behave in ways that can cause injury, harm, or property damage.
Pottery: 2 pieces are created per class however, there is a risk that pieces may break during firing. Additionally, firing can take up to 8 weeks after the class.
In consideration for being allowed to participate in activities involving animals at the Facility, I hereby release, waive, and discharge the Operator and the Facility, its owners, employees, agents, and representatives from any and all liability for any harm, injury, damage, or loss suffered by me, including but not limited to bodily injury, illness, or property damage, arising from or related to my interaction with animals at the Facility, regardless of whether such liability arises from the negligence of the Operator or otherwise.

I have read this waiver and fully understand its terms. By checking the check box, I voluntarily agree to its terms and acknowledge that I am giving up substantial rights, including my right to sue the Operator.
